Witnesses in civil and criminal cases, as well as legal proceedings involving non-Thai speakers and writers, are required to have an interpreter present in order to facilitate communication. Interpreters are of paramount importance in facilitating efficient communication for the witnesses. It is required that interpreters possess fluency in both the language of the witness and their native tongue. A comprehensive understanding of the law and legal procedures is essential for interpreters.

Licensing Requirements for Interpreters:

At present, Thailand lacks national legislation mandating the licensing of judicial interpreters. Every professional interpreter, according to the Southeast Asian Professional Interpreters and Translators Association (SEAProTI), is required to possess a "License to Practice as an Interpreter."

Interpreters from SEAProTI must be well-versed in the work process, legal procedures, and other pertinent details. Such knowledge instills confidence in the courtroom that the interpretation will be precise and devoid of any omissions, additions, or alterations of meaning.

SEAProTI interpreters must:

Successfully complete the Intermediate Legal and Medical Interpreter Training Course, which spans a duration of 48 hours.
After successfully completing this required training, they are required to pass a level-assessing knowledge exam. 1) A general knowledge examination encompassing legal and medical interpreting as well as professional ethics; and 2) A skills assessment comprising practical demonstrations of interpreting in arbitration, civil and criminal cases, hospitals, and public health.
After satisfying the 70-79=C2 and 80-100=C3 requirements, they are obligated to submit their certification application to the peer review system. This process entails obtaining two endorsements: 1) a general member of the Board of Trustees, and 2) a practitioner in the same field and at the same certification (prior to the peer certification, the secretary of the association shall publish the list of names of candidates on the organization's online portal, allowing other members 15 days to raise objections to the qualifications of the candidates).
Upon obtaining certification, SEAProTI will provide the interpreter with a "License to Practice as an Interpreter" and a name tag with a lanyard to facilitate courtroom duties (association pins and suits are optional; however, it is customary to use them for significant events or ceremonies in which the organization collaborates with government agencies).

The Role of the Court Toward SEAProTI Interpreters:

Particularly for SEAProTI interpreters, the court should verify the license of the interpreter prior to the start of the hearing.

Benefits of using licensed interpreters:

Prioritize efficient communication with the witness.
Preserve the integrity of legal proceedings.
Ensure that the translation of languages is precise and accurate.
Ensure that the credentials of SEAProTI interpreters are adequate for this type of interpreting.

Drawbacks of Using Unlicensed Interpreters:

May impede witnesses' ability to communicate effectively.
Unfair legal proceedings may result.
Potentially leading to erroneous linguistic translation.

SEAProTI Professional Membership:

Members of SEAProTI must:

Participate in training programs to acquire and maintain knowledge from the 10 CPD points per year; membership is valid for three years.
Particularly for pertinent employment, submit ten samples of your work annually. Both translators and interpreters are required to submit their respective work.
Renewal of membership is contingent upon the accumulation of CPD credits and work samples.

Conclusion:

Interpreters are of paramount importance in facilitating efficient communication for the witnesses. Licensed SEAProTI interpreters are required. It is the duty of the court to ascertain the credentials of the interpreters.

At present, there is a growing trend among justices to request interpreter licenses or certificates. The association wishes to extend its gratitude to all judges for their assistance and for aiding in the organization of all professions, as is the case in other nations. We will organize the system in accordance with international standards so that foreigners can have confidence that the Thai justice system is still supported by an organization that builds its credibility and ensures that it remains international. การใช้ล่ามในงานสืบพยานของ SEAProTI:

ในคดีแพ่งและคดีอาญา หรือในกระบวนยุติธรรมต่าง ๆ ที่มีคู่กรณีเป็นชาวต่างชาติที่ไม่สามารถพูดหรือเขียนภาษาไทยได้ จำเป็นต้องใช้ล่ามเพื่อสื่อสารให้พยานเข้าใจกระบวนการสืบพยาน ล่ามมีบทบาทสำคัญในการช่วยให้พยานสื่อสารได้อย่างมีประสิทธิภาพ ล่ามต้องมีความเชี่ยวชาญทั้งภาษาไทยและภาษาของพยาน ล่ามต้องมีความเข้าใจกฎหมายและกระบวนการสืบพยาน

ใบอนุญาตสำหรับล่าม:

ปัจจุบัน ยังไม่มี พรบ. ซึ่งเป็นกฎหมายระดับชาติของไทยที่กำหนดให้ล่ามในศาลต้องมีใบอนุญาต แต่สำหรับสมาคมวิชาชีพและล่ามแห่งเอเชียตะวันออกเฉียงใต้ (SEAProTI) ล่ามวิชาชีพทุกคนจะต้อง "เป็นผู้มีใบอนุญาตให้ประกอบวิชาชีพล่ามฯ" เนื่องจากเป็นงานสำคัญ และล่ามของ SEAProTI ทุกคนจำเป็นต้องรู้กระบวนการทำงาน รู้กระบวนพิจารณาคดี ฯลฯ อันจะทำให้ผู้คนในห้องพิจารณาคดีไว้วางใจได้ว่า ล่ามจะแปลได้ถูกต้อง แปลไม่ตัด แปลไม่เติม และไม่เปลี่ยนแปลงความหมาย

ล่ามที่แปลในศาลของ SEAProTI จะต้อง:

ผ่านการอบรมหลักสูตรล่ามกฎหมายและการแพทย์ ระดับ Intermediate จำนวน 48 ชั่วโมง
เมื่อผ่านการอบรมหลักสูตรภาคบังคับนี้แล้ว จะต้องสมัครเข้ามาทดสอบความรู้เพื่อวัดระดับ โดยข้อสอบจะมี ส่วนคือ 1) ข้อสอบความรู้ทั่วไปเกี่ยวกับการล่ามกฎหมายและการแพทย์ และจรรยาบรรณวิชาชีพล่าม และ 2) ทดสอบวัดความถนัดในวิชาชีพ เช่น สาธิตการทำล่ามในคดีแพ่ง คดีอาญา งานอนุญาโตตุลาการ และงานล่ามในโรงพยาบาลและงานสาธารณสุข

สมาชิกภาพของนักวิชาชีพ SEAProTI จะมีอายุ 3 ปี และสมาชิกจะต้อง
เข้าร่วมอบรมเพื่อฝึกฝนและเก็บความรู้จากโปรแกรม CPD ให้ได้ปีละ 10 แต้ม
การต่ออายุสมาคมจะขึ้นอยู่กับ แต้ม CPD และตัวอย่างงานที่ครบถ้วนเท่านั้น

ปัจจุบัน ผู้พิพากษาถามหาใบอนุญาตฯ หรือบัตรล่าม กันมากขึ้น ทางสมาคมต้องขอกราบขอบพระคุณผู้พิพากษาทุกท่าน ที่ช่วยกัน และช่วยเรา ทำให้ทุกวิชาชีพเข้าที่เข้าทางเหมือนในต่างประเทศ และเราจะได้จัดระบบให้เทียบเท่าสากล เพื่อให้ต่างชาติได้มั่นใจว่า กระบวนการยุติธรรมไทยยังมีอีกหนึ่งองค์กรที่ช่วยรักษาระบบให้เป็นสากล และสร้างความน่าเชื่อถือให้กับต่างชาติ และสร้างความเชื่อมันให้ต่างชาติเข้ามาลงทุนในไทยโดยไม่ต้องกังวลในเรื่องกระบวนการยุติธรรมไทยอย่างที่เคยเป็น

และนอกจากนี้ หากเราทำงานดี ใส่ใจในหน้าที่ ลูกค้าก็จะปากต่อปาก และส่งต่อหมายเลขโทรศัพท์ของเราให้ลูกค้าคนอื่น ๆ ไปด้วย
