Terps Spotlight Summit 2025: “Interpreting in Arbitration” by Wanitcha Sumanat
12 October 2025, Bangkok – This morning at the Terps Spotlight Summit 2025, Wanitcha Sumanat, President of the Southeast Asian Association of Professional Translators and Interpreters (SEAProTI), delivered a lecture titled “Interpreting in Arbitration.” The session drew significant attention from both professional interpreters and legal practitioners.
Wanitcha explained that interpreting in arbitration proceedings requires a high level of legal literacy, a thorough understanding of judicial procedures, and adherence to professional ethics. Interpreters, she emphasized, do not merely translate words but must accurately convey legal meaning and context in every utterance, as each translated word can affect the evidentiary substance and the fairness of the proceedings.
She added that interpreters must thoroughly understand the case background, avoid conflicts of interest, and maintain professional conduct and appearance throughout the process. “Every interpreter must understand the case context, avoid conflicts of interest, and perform professionally — in language, behavior, and appearance,” she noted.
Regarding interpreter selection in arbitration, Wanitcha highlighted that the process often mirrors court standards. Counsel typically select interpreters with prior experience in court or arbitration, following interviews or short interpreting tests. She underscored that interpreters are expected to render word-for-word interpretations rather than summaries to ensure the accuracy of testimonies. Moreover, they should review case files and legal documents beforehand to prepare adequately.
In her lecture, Wanitcha also connected Thai interpreting practices with international standards established by organizations such as the International Chamber of Commerce (ICC), the Singapore International Arbitration Centre (SIAC), and the Thailand Arbitration Center (THAC). Her remarks underscored the ongoing effort to align Thai interpreting practices with global arbitration norms.
Participants praised the session as both educational and inspiring, especially for emerging interpreters aiming to specialize in Legal and Arbitration Interpreting. This field demands not only linguistic skill but also deep legal understanding and professional integrity.

SEAProTI is the first professional association in Thailand and Southeast Asia to implement a comprehensive certification system for translators, certifiers, and interpreters.

12 ตุลาคม 2568, กรุงเทพมหานคร – เช้าวันนี้ที่งาน Terps Spotlight Summit 2025 มีการบรรยายหัวข้อ “Interpreting in Arbitration” โดย คุณวณิชชา สุมานัส นายกสมาคมวิชาชีพนักแปลและล่ามแห่งเอเชียตะวันออกเฉียงใต้ (SEAProTI) ซึ่งได้รับความสนใจจากผู้เข้าร่วมงานจำนวนมาก โดยเฉพาะกลุ่มล่ามมืออาชีพและผู้ที่ทำงานในสายกฎหมาย
วณิชชา สุมานัส ได้กล่าวว่า “การล่ามในกระบวนการอนุญาโตตุลาการ” เป็นงานที่ต้องใช้ทั้งความรู้ทางกฎหมาย ความเข้าใจในกระบวนการยุติธรรม และจรรยาบรรณวิชาชีพในระดับสูง ล่ามไม่ได้มีหน้าที่เพียงแปลคำพูดเท่านั้น แต่ต้องถ่ายทอด “ความหมายและบริบททางกฎหมาย” ให้ถูกต้องและครบถ้วนในทุกถ้อยคำ เพราะทุกคำที่แปลมีผลต่อสาระของพยานหลักฐานและการพิจารณาคดี
วณิชชา สุมานัส กล่าวว่า ล่ามควรมีความเข้าใจในคดีล่วงหน้า หลีกเลี่ยงผลประโยชน์ทับซ้อน และรักษาความเป็นกลางทั้งในคำพูด ท่าที และการแต่งกาย โดยระบุว่า “ล่ามทุกคนต้องเข้าใจบริบทของคดี หลีกเลี่ยงผลประโยชน์ทับซ้อน และต้องแสดงออกอย่างมืออาชีพ ทั้งในด้านภาษา กิริยา และการแต่งกาย”
สำหรับการคัดเลือกล่ามในกระบวนการอนุญาโตตุลาการ มักใช้หลักเกณฑ์ที่ใกล้เคียงกับศาล โดยทนายความจะเลือกผู้ที่มีประสบการณ์ด้านศาลหรือเวทีอนุญาโตตุลาการ และผ่านการสัมภาษณ์หรือทดสอบความสามารถเบื้องต้น ทั้งนี้ ล่ามต้องเน้นการแปลแบบคำต่อคำ ไม่สรุปใจความ เพื่อรักษาความถูกต้องของพยานหลักฐาน รวมถึงต้องศึกษาข้อมูลและเอกสารคดีก่อนการปฏิบัติงานทุกครั้ง
ในการบรรยาย วณิชชา สุมานัส ได้เชื่อมโยงแนวปฏิบัติของไทยเข้ากับมาตรฐานสากลในองค์กรระดับโลก เช่น ICC (International Chamber of Commerce), SIAC (Singapore International Arbitration Centre) และ THAC (Thailand Arbitration Center) เพื่อแสดงให้เห็นถึงแนวโน้มการยกระดับมาตรฐานการล่ามในกระบวนการยุติธรรมให้เทียบเท่าระดับนานาชาติ

สมาคมวิชาชีพนักแปลและล่ามแห่งเอเชียตะวันออกเฉียงใต้ (SEAProTI) ได้ประกาศหลักเกณฑ์และคุณสมบัติผู้ที่ขึ้นทะเบียนเป็น “นักแปลรับรอง (Certified Translators) และผู้รับรองการแปล (Translation Certification Providers) และล่ามรับรอง (Certified Interpreters)” ของสมาคม หมวดที่ 9 และหมวดที่ 10 ในราชกิจจานุเบกษา ของสำนักเลขาธิการคณะรัฐมนตรี ในสำนักนายกรัฐมนตรี แห่งราชอาณาจักรไทย ลงวันที่ 25 ก.ค. 2567 เล่มที่ 141 ตอนที่ 66 ง หน้า 100 อ่านฉบับเต็มได้ที่: นักแปลรับรอง ผู้รับรองการแปล และล่ามรับรอง
สำนักคณะกรรมการกฤษฎีกาเสนอให้ตราเป็นพระราชกฤษฎีกา โดยกำหนดให้นักแปลที่ขึ้นทะเบียน รวมถึงผู้รับรองการแปลจากสมาคมวิชาชีพหรือสถาบันสอนภาษาที่มีการอบรมและขึ้นทะเบียน สามารถรับรองคำแปลได้ (จดหมายถึงสมาคม SEAProTI ลงวันที่ 28 เม.ย. 2568)
