SEAProTI President Serves as Volunteer Certified Interpreter to Protect the Rights of Foreign Defendants
at Pathum Wan District Court in Line with International Human Rights Standards
31 January 2025, Bangkok — Wanitcha Sumanat, President of the Southeast Asian Association of Professional Translators and Interpreters (Southeast Asian Association of Professional Translators and Interpreters (SEAProTI), was requested by the Lumpini Metropolitan Police Station to perform duties as a Certified Interpreter at the Pathum Wan District Court in two criminal cases involving foreign defendants. In both cases, the defendants entered guilty pleas and did not contest the charges.
The assignment was carried out in the capacity of Public Service Interpreting, with a primary focus on safeguarding the fundamental rights of defendants and witnesses throughout the judicial process. This practice is fully consistent with Thailand’s Criminal Procedure Code, Section 13, which guarantees the right of individuals who do not understand the Thai language to receive appropriate assistance from an interpreter.
Upholding the ICCPR and International Obligations
Ms. Wanitcha’s interpreting duties were conducted in strict adherence to the International Covenant on Civil and Political Rights (ICCPR), a core human rights treaty under the United Nations, to which Thailand is a State Party. Particular emphasis was placed on the right to a fair trial and the right to effective and comprehensible communication at every stage of the justice process.
Presentation of Professional Credentials to Affirm International Standards
During the proceedings, Ms. Wanitcha presented her SEAProTI professional identification card and Certified Interpreter license as formal evidence of her professional status. These credentials were used to verify, for relevant authorities and foreign embassies in Thailand, that the Thai courts had provided certified Public Service Interpreting in accordance with recognized professional standards and international human rights obligations.
Such documentation is significant from the perspectives of the rule of law and international confidence, as it affirms that Thailand’s justice system accords equal importance to the rights of foreign defendants by engaging interpreters who meet established qualifications, maintain neutrality, and adhere to professional ethical standards.
Reflecting the Role of Professional Interpreters in the Justice System
This case underscores the essential role of professional interpreters as a cornerstone of rights protection within the justice system. Interpreters are not merely language conduits; they serve as guarantors that meaningful understanding does not become a barrier to justice—particularly in cases involving guilty pleas, where clarity, accuracy, and informed, voluntary consent free from linguistic distortion are paramount.
SEAProTI reiterates that Public Service Interpreting constitutes a public-interest and human-rights mission. The use of licensed and certified interpreters with clear professional standards is fundamental to the credibility and international standing of Thailand’s justice system.
About Certified Translators, Translation Certifiers, and Certified Interpreters of SEAProTI

31 มกราคม 2568, กรุงเทพมหานคร — คุณวณิชชา สุมานัส นายกสมาคมวิชาชีพนักแปลและล่ามแห่งเอเชียตะวันออกเฉียงใต้ (Southeast Asian Association of Professional Translators and Interpreters -SEAProTI) ได้รับการร้องขอจาก สถานีตำรวจนครบาลลุมพินี ให้ปฏิบัติหน้าที่ ล่ามรับรอง (Certified Interpreter) ณ ศาลแขวงปทุมวัน ในคดีอาญาจำนวน 2 คดี ซึ่งมีผู้ต้องหาเป็นชาวต่างชาติทั้งสองคดี และเป็นคดีที่ผู้ต้องหายอมรับสารภาพโดยไม่ประสงค์ต่อสู้คดี
การปฏิบัติหน้าที่ดังกล่าวเป็นไปในรูปแบบ ล่ามจิตอาสา (Public Service Interpreting) โดยมุ่งคุ้มครองสิทธิขั้นพื้นฐานของผู้ต้องหาและพยานในกระบวนการยุติธรรมอย่างเคร่งครัด สอดคล้องกับหลักการสิทธิมนุษยชนตาม ประมวลกฎหมายวิธีพิจารณาความอาญา มาตรา 13 ของประเทศไทย ซึ่งรับรองสิทธิของบุคคลที่ไม่เข้าใจภาษาไทยให้ได้รับความช่วยเหลือจากล่ามอย่างเหมาะสม
ยึดหลัก ICCPR และพันธกรณีระหว่างประเทศ
การทำหน้าที่ล่ามครั้งนี้ยึดหลัก การคุ้มครองสิทธิพลเมืองและสิทธิทางการเมือง (International Covenant on Civil and Political Rights (ICCPR)) ซึ่งเป็นสนธิสัญญาสิทธิมนุษยชนภายใต้ United Nations ที่ประเทศไทยเป็นภาคี โดยเฉพาะสิทธิในการได้รับการพิจารณาคดีอย่างเป็นธรรม (fair trial) และสิทธิในการสื่อสารอย่างเข้าใจได้ตลอดกระบวนการยุติธรรม
แสดงบัตรวิชาชีพและใบอนุญาต เพื่อยืนยันมาตรฐานสากล
ระหว่างการปฏิบัติงาน คุณวณิชชาได้ใช้ บัตรวิชาชีพและใบอนุญาตล่ามรับรองของ SEAProTI เป็นหลักฐานประกอบการปฏิบัติหน้าที่ เพื่อยืนยันต่อหน่วยงานที่เกี่ยวข้องและ สถานทูตต่างประเทศในประเทศไทย ว่าศาลไทยได้จัดให้มี Public Service Interpreting ที่ผ่านการรับรองตามมาตรฐานวิชาชีพ และสอดคล้องกับพันธกรณีด้านสิทธิมนุษยชนระหว่างประเทศ
การแสดงหลักฐานดังกล่าวมีความสำคัญในเชิงนิติรัฐและความเชื่อมั่นระหว่างประเทศ เนื่องจากเป็นการยืนยันว่า กระบวนการยุติธรรมของไทยให้ความสำคัญกับสิทธิของผู้ต้องหาชาวต่างชาติอย่างเท่าเทียม โดยใช้ล่ามที่มีคุณสมบัติ ความเป็นกลาง และจรรยาบรรณวิชาชีพ
สะท้อนบทบาทล่ามวิชาชีพในกระบวนการยุติธรรม
กรณีนี้สะท้อนบทบาทของ ล่ามวิชาชีพ ในฐานะกลไกสำคัญของการคุ้มครองสิทธิ ไม่ใช่เพียงผู้ถ่ายทอดภาษา แต่เป็นผู้ประกันว่า “ความเข้าใจ” จะไม่เป็นอุปสรรคต่อความยุติธรรม โดยเฉพาะในคดีที่ผู้ต้องหายอมรับสารภาพ ซึ่งต้องอาศัยความชัดเจน ความถูกต้อง และความสมัครใจโดยปราศจากการคลาดเคลื่อนทางภาษา

สมาคมวิชาชีพนักแปลและล่ามแห่งเอเชียตะวันออกเฉียงใต้ (SEAProTI) ได้ประกาศหลักเกณฑ์และคุณสมบัติผู้ที่ขึ้นทะเบียนเป็น “นักแปลรับรอง (Certified Translators) และผู้รับรองการแปล (Translation Certification Providers) และล่ามรับรอง (Certified Interpreters)” ของสมาคม หมวดที่ 9 และหมวดที่ 10 ในราชกิจจานุเบกษา ของสำนักเลขาธิการคณะรัฐมนตรี ในสำนักนายกรัฐมนตรี แห่งราชอาณาจักรไทย ลงวันที่ 25 ก.ค. 2567 เล่มที่ 141 ตอนที่ 66 ง หน้า 100 อ่านฉบับเต็มได้ที่: นักแปลรับรอง ผู้รับรองการแปล และล่ามรับรอง
สำนักคณะกรรมการกฤษฎีกา เสนอให้ตราเป็นพระราชกฤษฎีกา โดยกำหนดให้นักแปลที่ขึ้นทะเบียน รวมถึงผู้รับรองการแปลจากสมาคมวิชาชีพหรือสถาบันสอนภาษาที่มีการอบรมและขึ้นทะเบียน สามารถรับรองคำแปลได้ (จดหมายถึงสมาคม SEAProTI ลงวันที่ 28 เม.ย. 2568)
